¡Demanda de Café! El fabricante finlandés de teléfonos móviles Nokia ha presentado una denuncia contra Apple en un tribunal federal de Delaware (EEUU) al considerar que el teléfono móvil iPhone, desarrollado por la compañía estadounidense, infringe diez patentes vinculadas a la tecnología necesaria para hacer compatibles los dispositivos con uno o varios estándares registradas por Nokia.

En concreto, la reclamación de Nokia se refiere a diez patentes vinculadas a la tecnología necesaria para hacer compatibles los dispositivos con uno o varios estándares (GSM, UMTS y wireless LAN) y señala que los teléfonos iPhone han infringido estos derechos desde su lanzamiento en 2007, y en sus tres modelos (iPhone, iPhone 3G y 3GS).

“El principio básico de la industria de móviles es que aquellas compañías que contribuyen al desarrollo tecnológico para el establecimiento de estándares generan propiedad intelectual por la que los demás deben ofrecer una compensación. Al negarse a aceptar las condiciones apropiadas para la propiedad intelectual de Nokia, Apple está tratando de aprovecharse gratis de la innovación de Nokia” , dijo Ilkka Rahnasto, vicepresidente de Nokia en el área de propiedad legal e intelectual, mediante un comunicado oficial

La empresa finlandesa acusa directamente a Apple de haber podido rebajar el precio de sus productos al no tener que recuperar los costes de esas investigaciones.

Nokia aporta a la denuncia que ha invertido más de 40.000 millones de euros en investigación y desarrollo en los últimos veinte años , desarrollando una caretra de 10.000 patentes,. y señaló que ya ha alcanzado acuerdos de licencia para la utilización de las mismas con alrededor de 40 compañías, entre las que se incluyen virtualmente la práctica totalidad de las principales compañías de teléfonos móviles.

Apple vendió 7,4 millones de iPhones en el tercer trimestre de este año, mientras que Nokia, entregó 5,7 millones de terminales táctiles, en la misma gama que teléfono de Apple. Y mientras que la empresa norteamericana nada en beneficios, a la finlandesa no le van tan bien las cosas.

Apple registró entre julio y septiembre el mejor trimestre de su historia, con unos ingresos de 9.870 millones de dólares, un 25% superiores, y un beneficio de 1.820 millones de dólares, el 46% más que en el mismo periodo del año anterior. Nokia sues Apple in Delaware District Court for infringement of Nokia GSM, UMTS and WLAN patents

Espoo, Finland – Nokia announced that it has today filed a complaint against Apple with the Federal District Court in Delaware, alleging that Apple’s iPhone infringes Nokia patents for GSM, UMTS and wireless LAN (WLAN) standards.

As a leading innovator in wireless communications, Nokia has created one of the strongest and broadest patent portfolios in the industry, investing more than EUR 40 billion in R&D during the last two decades. Much of this intellectual property, including the patents in suit, has been declared essential to industry standards. Nokia has already successfully entered into license agreements including these patents with approximately 40 companies, including virtually all the leading mobile device vendors, allowing the industry to benefit from Nokia’s innovation.

The ten patents in suit relate to technologies fundamental to making devices which are compatible with one or more of the GSM, UMTS (3G WCDMA) and wireless LAN standards. The patents cover wireless data, speech coding, security and encryption and are infringed by all Apple iPhone models shipped since the iPhone was introduced in 2007.

“The basic principle in the mobile industry is that those companies who contribute in technology development to establish standards create intellectual property, which others then need to compensate for,” said Ilkka Rahnasto, Vice President, Legal & Intellectual Property at Nokia. “Apple is also expected to follow this principle. By refusing to agree appropriate terms for Nokia’s intellectual property, Apple is attempting to get a free ride on the back of Nokia’s innovation.”
